Sample Spay/Neuter Agreement
If you are adopting a puppy under the age of six months, you will be required to complete and agree to the terms of our Spay/Neuter Agreement. The following text is taken from our Spay/Neuter Agreement – please read it carefully, you will be required to agree to these terms if you are adopting an un-altered animal.
The following statement is required by Virginia law:
I agree to have the above described pet altered no later than (date) <date> by a licensed veterinarian of my choosing. I acknowledge that I am responsible for all costs associated with the spay/neuter of my pet and that A Forever-Home Rescue Foundation bears no obligation for these costs.
Low-cost spay/neuter services are available through Spay, Inc., an affiliate of the SPCA of Northern Virginia. For additional information, contact Spay, Inc. at www.spay.org.
I understand that by voluntarily signing this agreement, I am entering into a legal and binding contract with A Forever Home Rescue Foundation. Breach of any term(s) of this agreement is deemed actionable by AFH. In the event there is a violation of the agreement, I agree to pay a minimum of $1,000.00 in damages. Additionally, in order to facilitate the collection of damages for breach of contract, I waive any challenge to venue and agree that the appropriate venue for this matter is the Commonwealth of Virginia, and the County of Fairfax. Furthermore, I agree to accept service of process by certified mail, return receipt requested, to the address provided in this adoption contract, and specifically waive any right to receive personal service.
I certify that I have read and understand the terms of this Spay / Neuter Agreement. I acknowledge that failure to comply with these terms shall be considered a breach of contract and shall result in the immediate return of the adopted pet to A Forever-Home Rescue Foundation and may result in civil penalties as set forth in the referenced sections of the Code of Virginia.
Adoptive Owner: Within seven (7) days of the completion of the surgery, this form must be returned to A Forever-Home Rescue Foundation. In accordance with § 3.2-6576 of the Code of Virginia, it is your responsibility to ensure compliance with this requirement.
